Terms & Acceptable Use

These Terms govern your access to and use of Email Lists USA (the "Service") and any data you obtain through it (the "Data"). By purchasing or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What we provide

Email Lists USA provides access to a database of business contact information for U.S. real estate professionals, compiled from publicly accessible sources (brokerage and franchise websites and directories). You can purchase a list ("CSV") for a state segment.

2. License to use the Data

On payment, we grant you a non-exclusive, non-transferable license to use the purchased Data for your own legitimate business-to-business outreach. You may not:

resell, sublicense, rent, or redistribute the raw Data, in whole or in part;
publish the Data or make it publicly available;
use the Data to build a competing dataset or list-selling service; or
use the Data for any unlawful, deceptive, or harassing purpose.

3. Your compliance responsibilities (CAN-SPAM, TCPA & state law)

You are solely responsible for ensuring your use of the Data complies with all applicable laws, including the federal CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), and any applicable state marketing or privacy laws.

Without limiting that responsibility, you represent and agree that you will:

use accurate header and From information and subject lines that are not misleading, and identify commercial messages as advertisements;
include your valid physical postal address in every commercial email;
include a clear, working, no-cost unsubscribe mechanism in every commercial email and honor opt-outs within 10 business days;
not use the phone numbers in the Data for text messages or auto-dialed or prerecorded calls without the prior consent the TCPA requires; and
keep your own records demonstrating your compliance.

Email Lists USA does not send messages on your behalf and is not responsible for how you use the Data. Nothing on the Service is legal advice.

4. Payment, delivery & refunds

Prices are shown in U.S. dollars and charged at checkout via Stripe. The Data is a digital product delivered immediately after payment (by download and/or email). Because the Data is delivered instantly and its value is realized on disclosure, all sales are final and non-refundable once the list has been delivered, except where a refund is required by law. If you experience a technical problem receiving your file, contact us and we will make it right.

5. Accuracy & "as is"

We collect emails only as published on agents' own public brokerage profiles and re-collect them on a schedule; the build date of the file you buy is printed on every page. Contact data still changes constantly. The Data is provided "as is" and "as available," without warranties of any kind, including accuracy, completeness, deliverability, or fitness for a particular purpose. We do not guarantee any specific results from using the Data. A city list contains the agents we can place in that city and is a subset of its state file, not a census of every licensee.

6. Limitation of liability

To the maximum extent permitted by law, Email Lists USA and its operators will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits, arising out of or relating to the Service or the Data. Our total aggregate liability for any claim is limited to the amount you paid for the order giving rise to the claim.

7. Indemnity

You agree to indemnify and hold harmless Email Lists USA and its operators from any claims, damages, penalties, or costs (including reasonable legal fees) arising from your use of the Data or your breach of these Terms, including any claim relating to your messaging or calling practices or compliance with CAN-SPAM, the TCPA, or state law.

8. Changes & governing law

We may update these Terms from time to time; the "last updated" date above reflects the current version. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, where the operator is based.
